1. Introduction and Acceptance

These Terms & Conditions ("Terms") govern access to and use of the Albatross platform (the "Platform"), operated under the fantasy name "Albatross".

By accessing or using the Platform, you ("User" or "Guest") confirm that you have read, understood, and agreed to be bound by these Terms.

2. Role of the Platform

Albatross operates an online platform that enables Users to discover and book services offered by independent third-party service providers.

Albatross acts solely as an intermediary.

Albatross does not provide, own, operate, manage, or control any accommodation, activity, transportation, or personal service made available through the Platform.

3. Agency Capacity

For the purpose of facilitating bookings, Albatross acts in the name and on behalf of the relevant service provider.

Any contract for the provision of a service is concluded directly between the User and the service provider.

Albatross is not a party to such contract and does not assume responsibility for the performance of the service.

4. Service Providers

All services displayed on the Platform are provided by independent third-party service providers ("Service Providers"), including but not limited to:

• Accommodation providers
• Activity and experience providers
• Transportation providers
• Personal service providers (such as hairdressers or makeup artists)

The identity of the applicable Service Provider is clearly indicated at the time of booking.

5. Payments Collected on Behalf of Service Providers

For convenience, Albatross may collect payments from Users on behalf of the relevant Service Provider.

Amounts corresponding to the price of the service are collected by Albatross in its capacity as agent and are held temporarily on behalf of the Service Provider.
Such amounts do not constitute revenue of Albatross.

Albatross earns a commission for its intermediation services, which is deducted from the amount transferred to the Service Provider in accordance with the applicable agreement.

6. Pricing and Commission

Prices displayed on the Platform are determined solely by the Service Providers.

Albatross does not set, modify, or control service prices.

Any commission payable to Albatross is included in the displayed price unless otherwise stated.

7. Invoicing and Taxes

The Service Provider is solely responsible for issuing any invoice or receipt required by applicable law to the User, including the application and payment of any applicable taxes.

Albatross issues invoices exclusively for its intermediation commission to the relevant Service Provider.

Albatross does not charge taxes on services provided by third-party Service Providers.

8. Cancellations and Refunds

Cancellation and refund conditions are determined solely by the Service Provider and are disclosed at the time of booking.

Where a refund is due, Albatross acts solely as a payment intermediary and processes refunds on behalf of the Service Provider, in accordance with the provider's policies.

9. No Packages or Bundled Travel Services

Albatross does not offer package travel services or bundled offers. Each service is booked separately, even where multiple services are displayed together for convenience or planning purposes.

10. Liability

Albatross is not responsible for the performance, quality, safety, legality, or delivery of services provided by Service Providers.

Any claim, dispute, or complaint relating to a service must be addressed directly to the relevant Service Provider.

Albatross's liability is strictly limited to its role as an intermediary and payment facilitator.

11. Merchant of Record

Albatross does not act as the merchant of record for any service booked through the Platform.

12. Applicable Albatross Entity

Depending on the booking, intermediation services are provided by one of the following entities:

• Albatross, a société par actions simplifiée incorporated in France; or
• Chaves Agências de Viagens LTDA, a sociedade limitada incorporated in Brazil.

The relevant entity acting as intermediary is identified at the time of booking.

13. Intellectual Property

All content, trademarks, and intellectual property displayed on the Platform are owned by or licensed to Albatross and may not be used without prior written consent.

14. Governing Law and Jurisdiction

These Terms are governed by the laws applicable to the Albatross entity acting as intermediary for the relevant booking.

Any dispute shall be subject to the exclusive jurisdiction of the competent courts of the registered office of that entity.

15. Amendments

Albatross may update these Terms from time to time.

Material changes will be communicated through the Platform.
